The McCloud Remedy

McCloud is the remedy for the unlawful age discrimination found in the 2015 public-service pension reforms. It affects most members of NHS, teachers, civil service, armed forces, police, firefighters, judicial and most LGPS schemes who were in pensionable service between 1 April 2015 and 31 March 2022. The remedy rolls pre-2022 service back into the legacy scheme by default, and gives you a choice, the Deferred Choice Underpin, at the point you draw your pension.

What members usually ask

Will I be better off in legacy or 2015?
Depends on your scheme, salary path, retirement age and tax position. The point of the Deferred Choice Underpin is that you do not have to decide until you actually retire.
What is a Remediable Service Statement?
The official document your scheme administrator will issue showing both legacy and 2015 options side by side, so you can compare. How to read your RSS covers it section by section.
What about tax already paid on the wrong basis?
HMRC runs a public service pension adjustment process. Depending on your situation, you may owe more, be owed a refund, or be unaffected.
When will my statement arrive?
Depends on the scheme. NHSBSA has not published a firm timeline. Other administrators are working through cohorts in stages.
